Affordable Personal Encouragement Services Terms and Conditions Customer Information: You, (hereafter referred to as the customer) are engaging Rick Froyd, M.A., and Affordable Personal Encouragement Services for the specific purpose of providing supportive encouragement in reaching personal goals. Outline of Process Used: The customer shall have personal meetings with Rick Froyd, M.A., on an appointment only basis for the purposes of receiving support in clarifying, setting, and achieving goals. These meetings will be conducted using a live-online chat feature over the Internet, or by the telephone. In order to keep the costs of these meetings to the customer as affordable as possible, the customer is provided a TOLL FREE number to use for the meetings. There will also be the option in some cases for e-mail contact between meetings. There will be no office visits or in-person meetings. The basic method of services used by Rick Froyd, M.A., is to establish a positive, supportive, informative, and collaborative relationship with the customer with the overarching goal of helping the customer clarify, set, and achieve challenging, yet realistic goals in a quest to live more successfully. During the initial meetings, usually one to three meetings depending upon the customer, the customer and Rick Froyd, M.A., will explore and clarify goals through a goal setting procedure. A timeline will be established with the guidance of Rick’s help, for the achievement of these goals. The customer and Rick Froyd, M.A., will then establish how often the customer will desire personal encouragement meetings, and how long the length of each meeting will be. It is completely, thoroughly, and unequivocally understood that each customer is unique and that there is no pre-set number of meetings, time, or length of time to achieve goals for every person. Achieving goals is a very personal undertaking and may require a longer or shorter time for one person than it does another. It is also understood that some goals inherently take a longer time to achieve than other goals. If a goal is not ultimately achieved by the customer, to the customer’s satisfaction, Rick Froyd, M.A., nor Affordable Personal Encouragement Services, nor the customer will be held responsible in any way, shape, or form. It is completely, thoroughly, and unequivocally, understood by the customer that goal setting and achieving involves intrinsic risks. While many goals are achieved successfully in a short time, other goals may take a much longer time period to achieve, or a person may wish to re-think a particular goal. In the event a customer decides to change, or modify a particular goal, it is shall not be viewed as failure on the part of the customer, or of Rick Froyd, M.A., or Affordable Personal Encouragement Services. The customer understands that they are engaging Rick Froyd, M.A., and Affordable Personal Encouragement Services for the sole purpose of receiving compassionate, informative, and positive support in the process of setting and achieving goals. Further, the customer is fully aware and understands completely that Rick Froyd, M.A., and Affordable Personal Encouragement Services is not a medically approved medical advice service, nor a medically approved exercise and nutrition service, nor a licensed mental health service. The customer will be the deciding person as to how many meetings they will have, how long the meetings will be (within the existing meeting structure of Affordable Personal Encouragement Services structure design options), and how long they will maintain a business relationship with Affordable Personal Encouragement Services. In the conduct of business Affordable Personal Encouragement Services, and Rick Froyd, M.A., considers all persons using this service to be emotionally healthy, intelligent, and responsible. With regard to the operation of the services provided by this business, Rick Froyd, M.A., of and for, Affordable Personal Encouragement Services, considers the customer to be emotionally healthy, intelligent, responsible, and well able to judge for themselves how much personal encouragement they would like to have when they engage Affordable Personal Encouragement Services and Rick Froyd, M.A. Rick Froyd, M.A. places no specific limitations on a minimum or maximum number of meetings per agreement period. Refusal of Services: Rick Froyd, M.A., and Affordable Personal Encouragement Services reserves the right to refuse services to any persons who use profanity during the meetings, abuses the e-mail contact system, or in any other fashion does not conduct themselves in a respectful manner in the conduct of their business with Affordable Personal Encouragement Services. Fees and Payment Schedule: Affordable Personal Encouragement Services considers one of its main attractions as charging affordable fees. The following is the current (as of July 2005) fee structure offered for this agreement (these fees are subject to change without notice): An initial FREE 30-minute personal consult with Rick Froyd, M.A., for the prospective customer to inquire about the services and determine if this service would meet their individual needs. A thirty-minute meeting for $30.00 A sixty-minute meeting for $50.00 (please note the $10.00 savings.) Five separate twenty-minute meetings for $80.00, includes e-mail contact between meetings for the purposes of asking brief questions or sharing successes (please note the $20.00 savings and additional e-mail contacts). E-mails will be answered within 24 hours of receipt. Payment for this package is non-refundable once the first meeting has been used. There will be no pro-rated refunds if a client decides to vacate the agreement after having the first meeting. The 48-hour advance notice for cancellation policy applies to this package. Five separate sixty-minute meetings for $250.00. Includes unlimited e-mail contact between meetings (please note the $50.00 savings and unlimited e-mail contacts). E-mails will be answered within 24 hours of receipt. Payment for this package is non-refundable once the first meeting has been used. There will be no pro-rated refunds if a client decides to vacate the agreement after having the first meeting. The 48-hour advance notice for cancellation policy applies to this package. For those individuals who cannot afford to pay money for their meetings, arrangements can be made directly with Rick Froyd, M.A., via e-mail, to explore the opportunity to find another method of comparable compensation for services. From time to time, there will be specials for FREE twenty-minute meetings offered. Please check the website www.rickfroyd.com, frequently for the current special offer. These offers are open to new and established customers. All payments must be made using the Paypal link provided on the website. Affordable Personal Encouragement Services does not accept cash or checks. Affordable Personal Encouragement Services must receive payment at least 48 hours prior to any personal encouragement meetings taking place. A scheduled meeting must be cancelled 48 hours prior to the appointment to receive a refund (if eligible), or to reschedule the appointment in the case of a multiple meeting package. If the appointment is not cancelled or rescheduled within 48-hours, the monies paid and meeting time allocated for that meeting will be forfeited by the customer. All payments must be made in U.S. Dollars. Legal Notice: Affordable Personal Encouragement Services and Rick Froyd, M.A., shall not have liability or responsibility to any person or entity with respect to any of the encouragement or information he provides through his encouragement services. The persons using Affordable Personal Encouragement Services shall assume all risk for any injury, loss, or damage caused or alleged to be caused, directly or indirectly, by using these services. Medical Disclaimer: Services provided by Affordable Personal Encouragement Services are for supportive, educational, and informative purposes only. Encouragement given in the context of goal setting and achieving is not to be considered medical advice or professional mental health advice. Any person undertaking a comprehensive nutrition and exercise program should always consult their doctor for clearance prior to beginning any exercise, nutrition, or goal-setting program. If the customer currently has any disease such as heart disease, it is imperative that the customer contact their doctor, heart surgeon, or cardiologist, as well as a health-care practitioner with an exercise and nutrition background for their special nutrition and exercise program needs. Affordable Personal Encouragement Services seeks to assist individuals who wish to achieve their life goals, such as living successfully whether or not they have a disease, or if they currently have heart disease or other chronic disease, through providing information and supportive encouragement only. Rick Froyd, M.A. is not a medical doctor, clinical nutritionist, personal trainer, nor a licensed mental health professional. Nor is Rick Froyd, M.A., representing himself as any of the above-mentioned professionals in the performance of his services with Affordable Personal Encouragement Services. This Agreement: This agreement will be valid for each meeting that the customer purchases and engages in with Rick Froyd, M.A. This agreement constitutes the entire understanding of the parties (Rick Froyd, M A., and Affordable Personal Encouragement Services, and you, the “customer”). By filling out the form below and submitting it, you, “the customer” hereby agrees to the terms, conditions, and stipulations of this agreement on behalf of his or her organization or business, or self. The customer agrees not to hold Rick Froyd, M.A., or Affordable Personal Encouragement Services liable for any alleged or perceived damages for any reason whatsoever.
